FRESHLY HYGIENE TERMS OF SERVICE

OVERVIEW

These Terms of Service govern your use of the Freshly Hygiene online store and your purchase of products from us. In these Terms, “we,” “us,” and “our” refer to Freshly Hygiene. By visiting our store or placing an order, you agree to these Terms and any policies linked on our website. If you do not agree, do not use the store.

1. ELIGIBILITY AND ACCOUNTS

You must be legally capable of entering into a binding agreement in your location to use this store. You are responsible for providing accurate, current, and complete account, billing, shipping, and contact information. You are also responsible for protecting your account credentials and for activity conducted through your account.

2. STORE USE

You may use this store only for lawful, personal shopping purposes. You may not misuse the website, interfere with its operation or security, introduce harmful code, scrape or copy store content without permission, attempt unauthorized access, commit fraud, violate another person’s rights, or use our products or services for an unlawful purpose. We may restrict access or cancel orders associated with suspected misuse, fraud, or unlawful activity.

3. PRODUCT INFORMATION

We work to describe and display products accurately. Colors, packaging, labels, and other visual details may appear differently depending on your screen or may change between production versions. Product information is provided for general informational purposes and is not medical or dental advice. Mouthwash and other hygiene products do not replace appropriate professional care or a complete oral-hygiene routine. Always follow the directions, ingredients, warnings, and age restrictions printed on the product packaging.

4. PRICES AND AVAILABILITY

Prices, promotions, product availability, and product details may change without notice. Taxes, shipping charges, and other applicable fees will be shown when required during checkout. We may correct pricing or description errors and may cancel or refund an affected order. A product appearing on the website does not guarantee continued availability.

5. ORDERS

Your order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasonable reasons, including product unavailability, suspected fraud, pricing errors, payment issues, shipping restrictions, or incorrect customer information. If we cancel an order after payment, we will issue the appropriate refund to the original payment method.

6. PAYMENT

You agree to provide valid payment information and authorize the total displayed at checkout. Payments are processed by third-party payment providers, and their terms may also apply. We do not guarantee that every payment method will always be available.

7. SHIPPING AND DELIVERY

Estimated delivery is 7–15 days unless a different estimate is displayed at checkout. Delivery dates are estimates rather than guarantees and may be affected by carrier conditions, customs, destination, holidays, severe weather, inventory, or circumstances outside our reasonable control. You are responsible for providing a complete and accurate delivery address.

If we cannot ship within the promised time, we will follow applicable law regarding delay notices, consent, cancellation, and refunds. Risk of loss and title transfer as provided by applicable law and the selected shipping terms.

8. RETURNS AND REFUNDS

Return requests must be submitted within 30 days after delivery by emailing freshlyhygienebusiness@gmail.com. Include your order number, reason for the request, and photographs if the item arrived damaged, defective, or incorrect. Do not send a return until you receive return instructions.

To be eligible for a return, the product must be unused, unopened, complete, and in the same condition in which it was received. It must be returned in its original packaging with all included items, accessories, inserts, and components present. Products that have been opened, used, altered, damaged after delivery, or returned with missing pieces may not qualify for a refund.

For health and hygiene reasons, opened or used personal-care products are not returnable unless they arrived damaged, defective, or incorrect, or a return is otherwise required by law.

After an authorized return is received and inspected, we will notify you whether the refund is approved. Approved refunds are issued to the original payment method. Your financial institution may require additional processing time. Original shipping charges and return-shipping costs are non-refundable unless required by law or the return resulted from our error.

Nothing in these Terms limits any non-waivable consumer rights. Our separate Refund Policy forms part of these Terms and controls if it provides greater customer protection.

9. CANCELLATIONS

Contact us promptly if you need to cancel or change an order. We cannot guarantee changes after processing begins. If an order has already shipped, the Return and Refund terms apply.

10. INTELLECTUAL PROPERTY

The store’s branding, design, text, graphics, logos, photographs, videos, and other content are owned by or licensed to Freshly Hygiene and are protected by applicable intellectual-property laws. You may not reproduce, distribute, modify, sell, or exploit store content without prior written permission, except where the law permits.

11. THIRD-PARTY SERVICES AND LINKS

The store may rely on or link to third-party services, including Shopify, payment processors, shipping carriers, and fulfillment providers. We do not control every third-party service and are not responsible for third-party websites or content. Your use of those services may be subject to their separate terms and privacy policies.

12. WARRANTIES AND DISCLAIMERS

To the fullest extent permitted by law, the store and its content are provided on an “as is” and “as available” basis. We do not promise uninterrupted, error-free, or completely secure access. Any warranties that cannot legally be excluded remain in effect.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Freshly Hygiene and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the store or products. Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. This section does not exclude liability that legally cannot be limited.

14. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Freshly Hygiene harmless from third-party claims, losses, and reasonable expenses resulting from your unlawful misuse of the store, your violation of these Terms, or your infringement of another person’s rights.

15. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy. By using the store, you acknowledge that your information may be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide support.

16. FEEDBACK

If you voluntarily submit ideas, suggestions, reviews, photographs, or other feedback, you grant us a non-exclusive, worldwide, royalty-free license to use that content for operating and promoting the business, subject to applicable law and our Privacy Policy. You confirm that you have the right to submit the content and that it does not violate another person’s rights.

17. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on the store and changing the “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the store after an update means you accept the revised Terms.

18. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum lawful extent or removed, and the remaining provisions will continue in effect.

19. NO WAIVER

Our failure to enforce a provision does not waive our right to enforce it later. These Terms, together with the policies referenced on the store, form the agreement between you and Freshly Hygiene regarding use of the store.

20. GOVERNING LAW

These Terms are governed by the laws applicable in the State of Arizona, without limiting any mandatory consumer rights available under the laws of the customer’s location.
